在WTO法律体系中，非违法之诉是一项保护合法预期利益的程序救济制度，传统上GATT1947和多边货物贸易协议中非违法之诉保护的是基于货物关税减让而获得改善的市场准入和更佳的竞争条件的合法预期利益。《与贸易有关的知识产权协议》（TRIPS）是一知识产权最低保护标准的协议，没有关税减让的概念，非违法之诉在TRIPS中能否适用、如何适用（成立要件判定标准）、救济方式等问题在理论和实务界存在争议。

防止滥用知识产权是WTO框架下的TRIPs协议确立的一项基本原则。我国对于知识产权滥用的规制应该在TRIPs协议的框架下进行，既要充分利用TRIPs给予我们的立法空间，又要符合TRIPs协议的要求。我们应该就TRIPs协议中已经规定的对限制竞争行为的禁止、专利强制许可、滥用知识产权执法程序等几个方面来建立或完善规制知识产权滥用的制度，以全面履行TRIPs协议。
WTO规范具有深刻的公共卫生含义。作为WTO的主要规范，《与贸易有关的知识产权协定》（TRIPS协定）对于全球公共卫生治理具有重要意义。尽管TRIPS协定中包含了出于公共卫生考量而规定的灵活措施，然而，WTO并非以公共卫生为导向，其中所存在的结构性矛盾和缺陷决定了WTO对于发展中国家的公共卫生而言是弊大于利。鉴于我国目前面临的公共卫生危机和正在酝酿的医疗体制改革，我国应勇于利用WTO规范中的灵活性...
